Justice for rape survivors? Look at the Kobe Bryant case

The dropping of rape charges against NBA player Kobe Bryant last week is being portrayed as an agreement that makes both sides happy.

ABC News called it a win-win situation. I think not.

The fact is, the deck was stacked against that young woman from the beginning.

Bryant benefits, of course, because he’s no longer being prosecuted for rape. He’s made a statement that he’s sorry, and, by the way, he thought the sex was consensual

The young woman bringing the charges is alleged to be better off because she won’t have to go through a trial that has led to death threats against her, public trashing, national media exposure, three incidents of sealed court documents being given to the media and her name released – although news organizations aren’t using it.

Rape is clearly the one crime in which victims are equally on trial. In what other crime is the accuser as persecuted as the defendant is prosecuted?

Women seem to know they’re unlikely to get justice. Most rapes are not even reported. The U.S. Department of Justice says only 36 percent are reported to police. Other sources indicate even fewer.

In a study of 6,000 students at 32 colleges in the US, 42% of rape victims told no one and only 5% reported it to the police.
And what’s the likelihood of a rapist being punished?

Only 2% are convicted and imprisoned, according to a report issued by the U.S. Senate Judiciary Committee in 1993.

What kind of world are we handing over to our daughters? Clearly, it’s one in which there is little commitment to ending sexual assault –- or even punishing it.
